Are you planning on staying in you marital home? or have you been asked to leave? coz as far as i know you have right to stay in the house and your partner has to pay the mortgage...

All your income would be taken into account, your mat pay, any tax credit child benefit etc and your housing benefit would be calculated based on this income. You are more than likely to be eligible for some help towards your rent.

my dp has left me, i have ds1 3 years old and ds2 4 weeks old, we also have a morgage, i just would like to know if i could get a rented house and housing benefit while i was on maternity leave or would i have to pay rent out of maternity pay.

Isn't IS, HB & Council Tax benefit for people who have a household income of less than £15k per year and less than £8k savings in the bank?
If it still works on that, I can't see you having any problems claiming if you are just getting SMP, Child Benefit etc.
As soon as you find somewhere to rent, apply to go on the council housing list too (but not atm, as they wont add you on it as in their eyes by selling your house you are making yourself homeless), you get extra points for having a private rental as its usually high rent.
If you do rent privately, you probably won't get full housing and council tax benefit though even if you are on IS as well.
It's probably worth checking on that entitledto.co.uk (?) website, and also on the jobcentre website for what the requirements to claim are.
