    Im shocked, I know the tax creds dont take into account any cs i get off my ex through the csa, but i didnt no the csa take tax creds into account my ex mite get if he was getting them, thats awful

    i know they take into account tax credits but what if we were both working? would they take into account my wages aswell as his?

    They just go off the tax credit award, it would be irrelevant where it's paid into. You could always change the bank account where it's paid into, if you wanted though. Jo x

    Hi, you wouldn't pay anything because the tax credits would top up your wage and not his. They couldn't be touched. Jo

    so if my dp dnt work but tax creds in joint names can they touch them

    If we do end up on the new system dh has already told me to get rid of our tax credits as for what we get each month (not alot really) it is not worth it if they will take this as an income & the ex will get more money.

    Thanks for clarifying ladies. It is so unbelievable!!! I'm glad we have worked out payments between us as I would hate to think of her getting tax credits for her own children and then part of my son's money too! I would be so cross.

    They used to include the familys supliments that was out before tax credits, I can't remember the name of it on the old system too!!

    It used to wind me up as his ex would get full rate so did we and there was her and SDD, we had both of us and our DD in nappes and they used to give her the same top up as us then the money from us on top of that as it wasn't counted as income so she was in effect £80 per week better off then us!

    Hi Karla,

    On the new system, tax credits are taken into account to work out maintenence payments if the nrp is the main earner in the house. It won't tell you this on the csa website though.

    For e.g, my husband has 2 children from previous relationship, he is main earner in our house as I look after my 4 children and only work part time.  He pays 20% of his earnings, tax credits are included as part of his income. However if I was the main earner, she wouldn't yet anything.

    Can someone please clarify for me ....can the csa really claim part of your tax credits for your children to pay the ex? How on earth does this make any sense??? Why does the government feel that children from first relationships are more important than subsequent children? I am fuming, I hope I have misunderstood this.

    Forgot to say. On the new system, if you are the main earner, she would get nothing.

    Maz, no justice at all. We have looked into so much in the last couple of years and recently tbh. As your hubby is the main earner, if she does do what you think she will, you will pay 15% of his earnings and 15% of your tax credits awarded to your 2 children. She however will not have to declare her maintence payments when her tax credits are calculated. You will get a percentage deducted for your 2 children but it's not worth a carrot. As I said, no justice at all. This is all above board, and is lawful. Amazing. You have to fight against it though, even if it's just to make you feel better and in the hope that if enough people complain, something might be done about it. pm me if you want to talk at anytime, I know what your going through.

    Hubby just has the 1 kid & we have 2 together youngest being 7 months old I have always worked but whilst being on the old system I aint getting a job as I have always had to declare what I earn.

    We also have the added expensive of an annual train ticket just for him to get work & on the old system we are on they take this into consideration so if we go onto the new one then god help us as our morgage has gone up plus all the other bills.

    Where is the justice in it all

    I know how annoying it is and how wrong that someone can just change the rules, when it's not going their way. We too appealed and although the judge was on ourside, it didn't change the outcome. We went from nil assessment to £250, in space of a few months. Her payments went down originally when we had twins ad I stopped working, hence her decision to close the case. My main grievance is that same percentage of our tax credits are taken into account, as well as his earnings. which is disgusting. How many step and your children do you have?

    we think thats why she is closing it so she can reapply 13 weeks later as her money has dropped & she obviously wants us on the new system but my hubby has already started an appeal & has written letters to our local mp & yet the csa again he is not going doing without a fight which I don't blame him & yes we will be worse off.

    Hi, yes they can I'm afraid and there's nothing you can do about it. Why has she closed the case if you don't mind me asking? The same thing happened to us a couple of years ago. We ended up worse off, as she re-applied 13 weeks later to the csa and we automatically got put on new system, a percentage of his wage and our tax credits.

    Close down your account on the say so of the parent with care even if the father appeals against this decision & wants to continue to pay.

    Any advice would be great
