Do you still get paid any holiday entitlement earned while on Maternity leave even if you dont return to work then ?? Cant work it out ! lol

thank you so much for all your advice, i have now been on the phone to HR and my boss just hasn't got a clue, she said that yes i do accrue it and even better she says i should take it before commencing MA which is exactly what i wanted to do.
can't wait to go in with my letter today and shove it in his face. (actually he's alright just hasn't got a clue!!!!)

Whether you claim smp or ma, everybody is entitled to the same rights regarding holiday. You still accrue holiday whilst on maternity leave. Youre employment is not suspended. The amount of holiday accrued depends on wot your contract states. But check out this link

i get ma and have still accrued my holidays your boss needs to read his paperwork i have to keep re educating my boss and some of the hr department they dont have a clue

thank you so much for your replies some have really made me chuckle.
i am going to ring the CAB now and see what they say then when i go into work find out how i contact HR, i'm in retail so hr is way up north somewhere so don't have anything to do with them.

When you are on maternity lave regardless of weather you receive full maternity lave or maternity allowance, you are still employer in your current position and accrue the normal ammout of hoilday. So if you take 9 months you should get 9 months. Or whatever you have left at the start of your emlpoyers holiday year.

Sorry but your boss is talking a load of bull s***
Your contract can not be suspended for 9 months just because you are on maturnity. you are still employed! read your contract if it doesn't say anything in your contract about suspending your employment then they cant.
i started my new job in may this year and left on maturnity in september i have taken all of my holiday up until the end of the holiday cut off period and i will have holiday to take when i go back next year.
question your HR department about it, some managers dont know S***, mine didn't think that i would be intitalled to any holiday but when i spoke to hr they said that i had all my holiday to take and i would be paid for my antinatal appointments as well.
If you still have no luck Speak to citizons advise, they will give you all you need to know about what you are entitalled to, also your MW should be able to tell you as well.

I am going to acrue holidays but i will be getting smp. if in doubt look on the acas website.

I don't know about your individual company but it usually works that you get 1.5 days holiday for every month you are there. So say its been 6 months, you would have 9 days holiday. I think you should check the hm website. Or better still ring the cab for advice!

been to see boss man today to sort out when i am leaving,
unfortunately i have to claim ma as i was pregnant when starting there which is fine thats not my problem, i was on the understanding ( and have googled this) that i was still under contract so accrue holiday even when on maternity leave????????? he is telling me that because i have to claim ma i do not accrue any holiday cause for want of a better word my contract is suspended for 9 months, i am really confused by all this and was hoping someone on here might be able to help me as to whether he is right or wrong.
he's been ever so good about everytihng so don't want to go guns blazing but if i'm entitled to it then i want it.
