hiya, not good news from me im afraid. i sold something a while back to someone and they paid straight away with paypal so i sent out the goods first class. she won them on the saturday i sent them the following monday. on that monday after winning them(!!!) she opened a dispute against me saying she hadn't got them! i explained to paypal that how could she have got them when she didnt win them the sat evening....then is she then said she might have got them, but had been away, and didnt know, went on for a week i kept asking if she had them, she just kept saying oh i dont know i will ask the neighbour etc but didnt close the dispute, then paypal said they had found in favour of the buyer, even though it didnt make sense for her to open the dispute at that time, and by this stage she had 10 disputes open for non payment and 10 neg feedback on her! but ddi that matter? did it s***e...once paypal took that money and gave it back to her i never saw it again and i sent email after email to paypal saying it was ridiculous she couldnt have looked more suspect if she tried but still all us sellers with fantastic feedback who had sent our items were all getting conned....all i got was a load of template emails sent to me, and because i hadn't sent the item recorded, i was well and truly buggered - i had always thought paypal protected me, does it s***e. i am riled up again now, because they charge ridiculous amounts for you to list items to be paid with paypal and then don't have the decency to get back to you when you are clearly the innocent party. sorry but now you know i do feel for u and rant over!

Have you also put whats happened on a thread on community section of ebay. Ive used that before and theyve been helpful.

Make an official complaint to paypal about paypal and they have to action and follow the complaint through as they are governed by the FSA the same as banks. If you do a google search on paypal & fsa you will see people who have had similar probs and got there money back.

    This is quite useful

I had a similar problem about 12mths ago, it was only for about £20 but it was the principal. Id done my part and sent the item tracked and it was signed for etc, I fought it with paypal and got them to put the money back into my account. GOOD LUCK! xx

it sounds like a chargeback where hes gone to his card issuer to get it back or it was initially allowed by the bank then they rejected it so its not actually pp its his bank or the man,    now its fraud so go to the police ive had to do this before and they dont like dealing with ebay but as it happened the person that  frauded me was actually wanted for other things anyway you need a incident no. from police you could threaten to take pp to court as they have allowed this to happen but as i said earlier they may blame the bank id call pp and ebay im afraid all you can do with ebay is open a non payment dispute

ebay and paypal are getting beyond a joke!  I had someone who won an item and never paid for it yet I couldnt leave her negative feedback!  Then you get decent sellers that van get ripped off left right and centre and they just let it happen.  I had loads to list on ebay this weekend but am really worried about it now.

I've emailed watchdog now, and please could all of you who've had the same happen to them do the same. The mors of us that complain, then the more likely we are to get listened to. This man who bought my phone has a feedback of 268 and has been a member of ebay for 3 1/2 years, but according to paypal, his paypal account is new. I dont understand it. I am going to give him til tomorrow then go to the police. I cant believe paypal can do this.

Definately contact the police, im sure they will be interested with it being a fraud case. And definately contact Watchdog about how you have been treated. If enough people do this then they will look into it!

I would be so upset too, this is really unfair. Not sure whether i'll sell anything on e-bay again after hearing this. I have bought a few things recently, and I would hope that by paying by Paypal I am covered if any probs, but you do wonder.

Surely if he used a fraudulent credit card, and you posted the phone to his address, and he has confirmed receipt, then you have all the details needed to go to the police.

He has committed theft, therefore you have a right to try and recover your money or the phone you sold!

Please dont give up on it!

    Good luck, Emma

No, if he used a stolen credit card then I wouldn't think he will be be in touch to pay you.  That is so unfair!!

I will think twice now before listing things on ebay.  In my opinion it's PayPal who are at fault and they should have to pay up - lets face it they make enough from charging you fees!!

Can you not change your listing that ends soon to say you want payment as a cheque?  I know it could put people off though as it means it will take ages to get the item (having to wait for cheque to clear).

I'm so angry. I phoned paypal and they just said that the payment was made with a fraudulent credit card. Their only advice is to go to the police, but they will not do anything. I'm stuck. I have another item on ebay which will end tomorrow and I'm so scared this will happen again. I have emailed the bloke who bought my item but I dont hold out much hope. Thanks for your replies but I think I just lost out on this one.

Ebay have been tightening up their policies lately.  A month or so ago I couldn't send some items to buyers and consequently, they were late.  I did have a good reason and informed them as soon as I could.  However I received 2 neutral and 1 negative feedback.  Ebay have now suspended my account and have told me that I have to resolve the issues with the buyers.  Everyone received their items and I have had 2 emails from the buyers who left neutral saying everything fine.  Trouble is I have had no contact from the buyer who left the neg feedback.  I have explained to them that unless they can confirm that they received the item and everything is fine.  Ebay will ban me.  I don't think this is a particularly good wayto treat people especially as I have been using it since 2001 and have feedback of 750+.

I know that the buyer is still using ebay as they have been buying things recently so is just making it hard for me.

I think there is something odd going on with Paypal then... this has just happened to me too with an item I sold. As far as I am concerned Paypal are at fault for telling me that the payment was cleared and i have told them that... have also said I am makiofficial complaint and will go to watchdog!!!

the buyer put in a complaint (and we've found out shes done this to quite a few sellers) so amazon have gave her the money back without sending the items back :S

Thats scary!  Surely they can't do this!!?  I would contact him via ebay email and also speak to PayPal.

If nothing comes from that I would do what a pp said and write to him via recorded mail, then you have some evidence.  I would also enclose a copy of the PayPal email that says the payment has been cancelled.

Let us know how you get on.

    Good Luck!

As said, the error is with Paypal not you, they shouldnt have cleared the payment in the first place.

If the guy doesnt get back to you, write to him via recorded delivery, keeping your receipt (and tracking number) and a copy of the letter. If he doesnt reply, or replies saying he wont pay then go to the police because it is then theft and you have proof of why you didnt get payment from paypal, plus proof he has no intention to pay by his response (or lack of) after he'd signed for your letter. Dont let him get away with it.

Whats his other feedback like? You defo need to contact e-bay regarding his account.

Keep us posted and best of luck! xx
